What is Bad Faith?
An insurance company owes a duty of good faith to all persons they insure. A duty of good faith requires the insurance company effectuate a prompt and equitable settlement once liability has become reasonable clear. If your insurance company unreasonably denies benefits to you or delays payment of your claim under an enforceable insurance policy, you may have a basis to sue your insurance company for “bad faith“.
How do I know if my damage is covered?
When determining whether a loss or damage to your property is covered, there are several things to be considered such as your policy and the date of loss. Every policy is different, some policies only cover named perils, while other “broad form” policies insure a larger variety of losses. Another question to consider is whether the damage was pre-existing (before the date the policy took effect) or if the damage is long term and ongoing. Most policies only cover sudden and accidental damage. If you have any questions regarding your claim or any damage or loss to your property, please contact the Law Office of Dalli H. Seyb to review your claim for free.
The insurance company keeps denying my claim, how long do I have to sue them?
The amount of time you have to file a lawsuit against your insurance company is determined by the Statute of Limitations. The Statute of Limitations often depends on your policy and can vary from carrier to carrier and state to state. However, in most circumstances, under a homeowner’s policy you have one year after the loss to file a lawsuit. If the loss is a commercial loss, the statute of limitations is often two years. In any case, it is imperative that you act promptly after a denial or mishandling of your claim to contact a knowledgeable insurance attorney that can take a look at your claim and determine if a lawsuit is warranted.
